These Terms of Service (“Terms”) govern your use of the services provided by Muse of Whimsy LLC (“Muse of Whimsy,” “we,” “us,” or “our”), a New York–based tarot and astrology business. By booking, purchasing, participating in, or otherwise engaging with our services, website, events, or other offerings, you agree to these Terms.

If you do not agree to these Terms, please do not book or use our services.

1. Our Services

Muse of Whimsy provides tarot, astrology, and related spiritual services for personal, spiritual, and entertainment purposes.

Our services may include:

• Individual tarot readings

• Individual astrology readings and chart interpretations

• Asynchronous tarot or astrology readings

• Live virtual readings and consultations

• Virtual services conducted through platforms such as Zoom or other third-party platforms

• In-person tarot and astrology readings

• Tarot and astrology services for private or public events

• Collective readings and other spiritual content.

• Other related services, content, workshops, or offerings, virtually or in person.

Services may be provided virtually, asynchronously, or in person, depending on the offering purchased.

The specific description, format, timing, and price of a service will be provided at the time of booking or purchase.

2. Spiritual and Entertainment Purposes

Tarot and astrology are offered by Muse of Whimsy for spiritual, personal, reflective, and entertainment purposes only.

Tarot and astrology are not substitutes for professional medical, psychological, psychiatric, legal, financial, business, or other licensed professional advice, diagnosis, treatment, or care.

You are responsible for your own decisions and actions. Our services are intended to support personal reflection and exploration, not to make decisions for you.

We believe that everyone has personal agency and that circumstances can change. We do not represent tarot or astrology as a guaranteed method of predicting the future or determining a fixed outcome.

Any discussion of possible future circumstances, outcomes, patterns, or interpretations represents an opinion, interpretation, or spiritual perspective and is not a guarantee or prediction of a certain result.

3. Professional Advice and High-Stakes Decisions

You should not rely on a tarot reading, astrology reading, chart interpretation, or other Muse of Whimsy service as the sole basis for making decisions concerning:

• Medical or health matters

• Mental health or psychological treatment

• Pregnancy or fertility

• Legal matters

• Financial investments or financial planning

• Employment or business decisions

• Personal safety

• Criminal investigations or allegations

• Other matters requiring professional expertise

When appropriate, you should consult a qualified professional.

Muse of Whimsy does not provide medical, psychological, psychiatric, legal, financial, investment, or other licensed professional services.

4. Topics We Do Not Read On

As part of our ethical practice, Muse of Whimsy does not provide tarot or astrology readings intended to:

• Determine a person's date or circumstances of death

• Diagnose illness or pregnancy

• Investigate unsolved crimes or mysteries

• Predict lottery or gambling outcomes

• Predict or advise on stock-market or investment outcomes

• Predict the weather

• Guarantee whether an ex-partner or another person will return

• Read another person's mind

• Guarantee a specific future event or outcome

We may decline, modify, or redirect a reading request if we believe the requested service is inconsistent with our ethical standards or these Terms.

Using intuition, symbolism, tarot, or astrology is not the same as reading minds or possessing certainty about future events.

5. Personal Agency and No Guaranteed Outcomes

Muse of Whimsy does not guarantee that a particular event, relationship, financial result, career outcome, or other circumstance will occur.

You acknowledge that you retain responsibility for your own choices and decisions.

A reading should not be understood as removing your ability to choose, change direction, seek professional assistance, or make decisions based on additional information.

6. Eligibility

Our services are intended for individuals 18 years of age or older.

We do not knowingly provide readings to individuals under 18. If we learn that a booking was made by or for a person under 18, we reserve the right to cancel the service and issue any refund required under our applicable cancellation policy.

7. Booking and Payment

A booking is not considered confirmed until the applicable booking requirements have been satisfied.

Depending on the service, payment may be processed through Squarespace, Stripe, Square, PayPal, Cal.com, or another third-party payment or scheduling provider.

We do not store full credit-card numbers or banking information ourselves.

You are responsible for providing accurate booking and contact information and for monitoring the email address associated with your booking.

8. Astrology Information

Certain astrology services require information such as your:

• Full or preferred name

• Date of birth

• Exact or approximate time of birth

• Place of birth

• Other information reasonably necessary to provide the service

You are responsible for providing information that is as accurate as reasonably possible.

If you provide incorrect or incomplete birth information, the resulting chart or interpretation may be inaccurate. Muse of Whimsy is not responsible for inaccuracies resulting from information supplied by the client.

You are never required to disclose personal information beyond what is reasonably necessary for the service you have purchased.

9. Asynchronous Services

For asynchronous readings, the expected format and delivery timeframe will be communicated at the time of booking.

Depending on the service, an asynchronous reading may be delivered in written, audio, video, or another specified format.

Once an asynchronous reading has been substantially completed or delivered, refunds may not be available except as specifically provided under our cancellation/refund policy or as otherwise required by applicable law.

If we experience an unexpected delay, we will make reasonable efforts to communicate with you and provide an updated delivery timeframe.

10. Virtual Questionnaire Requirement

For virtual readings or services requiring a client questionnaire, the questionnaire must be completed within the timeframe specified at booking.

For virtual tarot appointments, the questionnaire must generally be completed within one week of booking unless otherwise stated.

If you do not complete a required questionnaire within the applicable timeframe, Muse of Whimsy may cancel the appointment and retain the payment because the reserved appointment time may no longer be reasonably available to another client.

It is your responsibility to monitor the email address associated with your booking and complete required forms.

If you do not receive a required questionnaire within 36 hours of booking, please contact us at tarot@museofwhimsy.com.

We may send automated reminders regarding incomplete forms.

11. Live Video Readings

Live video readings may be conducted through Zoom, Cal.com, or another designated third-party platform.

For services requiring an invoice, the invoice may be sent within approximately 12 hours of booking and must generally be paid within one week of the appointment being booked.

Bookings made within 24 hours of the requested appointment date may be subject to an additional expedited-booking fee:

• Astrology services: $25

• Tarot services: $15

Any applicable expedited fee will be disclosed on the invoice or at booking.

You are responsible for having a reliable internet connection and the equipment reasonably necessary to participate in a virtual session.

Technical problems caused by the client's equipment, internet connection, or failure to access the appointment on time do not automatically entitle the client to a refund.

12. In-Person Sessions and Events

For in-person sessions and events, the applicable cancellation and refund terms will depend on the specific service or event.

Clients are responsible for arriving at the agreed location at the scheduled time.

Muse of Whimsy may establish reasonable event-specific requirements concerning location, timing, conduct, accessibility, photography, video, capacity, or other logistical matters.

13. Client Conduct and Right to Refuse Service

We are committed to treating clients with respect regardless of race, religion, gender, sex, sexual orientation, or other protected characteristics.

Clients are expected to communicate respectfully with Muse of Whimsy and any event staff, contractors, hosts, or other participants.

We reserve the right to refuse service, cancel a booking, or discontinue a session when reasonably necessary, including in circumstances involving:

• Harassment, threats, discrimination, or abusive behavior

• Repeated disrespectful or inappropriate conduct

• Attempts to pressure us into providing services that violate our ethical standards

• Requests for services we do not provide

• Conduct that creates a safety concern

• Repeated bookings that we reasonably believe demonstrate unhealthy or compulsive dependence on tarot, astrology, or spiritual services

We do not encourage addiction or unhealthy dependence on tarot readers, astrologers, psychics, or spiritual practitioners.

Tarot and astrology are not replacements for psychological or mental-health care. We encourage clients to seek appropriate professional support when needed.

14. Cancellation and Refund Policy

Our cancellation and refund policies depend on the type of service purchased.

A. General Booking Cancellation

If you pay for a reading and subsequently change your mind because you cannot wait for our availability or no longer want the reading, your payment may be refunded minus a $15 administrative fee if your request is received within 24 hours of booking.

After that period, the applicable service-specific cancellation policy applies.

B. Virtual Services

For virtual services requiring a questionnaire, failure to complete the required questionnaire within the stated timeframe may result in cancellation without a refund.

C. Live Video Readings

Appointments booked through Cal.com are refundable up to 48 hours before the scheduled event, subject to the terms displayed at booking.

For cancellations made less than 48 hours before a live video reading, the client will receive a 50% refund.

Cancellations made within 24 hours of the appointment are non-refundable.

D. In-Person Sessions and Events

Cancellation and refund terms for in-person sessions and events are determined on a case-by-case basis, depending on the nature of the service or event.

Where an in-person session or event is subject to a separate client contract, agreement, invoice, or event-specific cancellation policy, that document will contain the applicable cancellation and refund terms.

Clients should review their client contract and event-specific terms carefully before booking or entering into an agreement with Muse of Whimsy.

E. Cancellations by Muse of Whimsy

If Muse of Whimsy must cancel a service for reasons within our control, we will make reasonable efforts to reschedule the service or provide an appropriate refund.

Nothing in these Terms limits any refund or other rights you may have under applicable law.

15. Lateness and Missed Appointments

Clients are responsible for arriving or logging into their appointment on time.

If you are late to a live appointment, the session may still end at the originally scheduled time so that subsequent appointments are not affected.

If you miss an appointment without providing notice, the appointment may be treated as a cancellation and may not be eligible for a refund.

We may make reasonable exceptions in circumstances beyond the client's control.

16. Recordings and Photography

Individual Sessions

Individual sessions are not routinely recorded by Muse of Whimsy.

However, with the client's request and consent, Muse of Whimsy may record an individual session for the client's use.

Where we create a recording specifically for a client, the recording may be treated as part of the purchased service.

Asynchronous Video Readings

Muse of Whimsy may create video recordings as part of an asynchronous tarot or astrology service.

Events and Collective Content

Virtual and in-person events may be photographed or recorded for documentation, promotional, educational, archival, or social-media purposes, subject to applicable consent requirements and any event-specific notice.

Muse of Whimsy may also create collective tarot or astrology readings for social media or other public content.

Where an event recording or promotional recording includes identifiable attendees, we will make reasonable efforts to provide appropriate notice and/or obtain consent where required.

Client Recordings

Clients may not record, livestream, reproduce, or distribute a live session without Muse of Whimsy's permission.

If we permit a client to make a personal recording, that recording is for the client's personal use unless we provide written permission for another use.

17. Confidentiality

We treat information shared during individual readings as confidential and will not intentionally disclose the content of a private reading to third parties except:

• With your consent;

• To service providers reasonably necessary to provide our services;

• When required by law; or

• When reasonably necessary to protect our rights, property, safety, or the safety of others.

Please see our Privacy Policy for additional information about how personal information is collected, used, stored, and disclosed.

Confidentiality may not apply to information that you voluntarily make public or share with others.

18. Intellectual Property

All original materials created by Muse of Whimsy, including but not limited to:

• Written readings

• Astrology interpretations

• Tarot interpretations

• Original videos

• Audio recordings

• Worksheets

• Guides

• Educational materials

• Website content

• Social-media content

• Branding, graphics, and designs

• Original methods, written materials, and other creative works

are owned by or licensed to Muse of Whimsy unless otherwise stated.

Purchasing a reading or service does not transfer ownership of Muse of Whimsy's intellectual property to the client.

You may use a reading or other purchased material for your own personal, non-commercial purposes.

You may not:

• Resell a reading or interpretation;

• Present our work as your own;

• Use our materials for a commercial service;

• Repackage or reproduce our work for sale;

• Train or develop a commercial product using our proprietary materials;

• Publish or distribute substantial portions of a reading without permission; or

• Otherwise commercially exploit our work without written permission.

If you share a portion of a reading or other Muse of Whimsy content publicly, you must provide clear attribution to Muse of Whimsy LLC and, where applicable, tag or otherwise identify our official account or website.

Nothing in this section prevents Muse of Whimsy from separately agreeing to create work for a client under a freelance, commissioned, work-for-hire, licensing, or other written arrangement. The terms of that separate agreement will govern the commissioned work.

19. Client Materials

You retain ownership of personal information, photographs, writings, questions, and other materials that you provide to Muse of Whimsy.

By submitting materials necessary to provide a service, you grant Muse of Whimsy permission to use those materials as reasonably necessary to provide the service.

We will not publicly share private reading information or client-submitted personal information for promotional purposes without appropriate permission.

Our handling of personal information is also governed by our Privacy Policy.

20. SMS and Email Marketing Communications

By opting in to receive marketing communications from Muse of Whimsy LLC, you consent to receive promotional and marketing communications from us by email and/or SMS text message, depending on the communication preferences you select.

Marketing communications may include information about:

• New or upcoming services;

• Tarot and astrology offerings;

• Events and workshops;

• Promotions and special offers;

• Availability and booking opportunities;

• Newsletters;

• Muse of Whimsy content; and

• Other updates or information we believe may be relevant to you.

Marketing consent is not required to purchase or receive our services. You may choose whether to receive marketing communications and may opt out at any time.

For email marketing, you may unsubscribe at any time by using the unsubscribe link included in our marketing emails or by contacting us directly.

For SMS marketing, you may opt out at any time by replying STOP to a marketing text message or by contacting us directly. You may also receive additional automated messages confirming your opt-out.

Opting out of marketing communications will not affect your ability to receive services you have already purchased or booked. You may still receive necessary transactional or service-related communications, such as appointment confirmations, reminders, invoices, scheduling information, or other communications necessary to administer a service you have requested.

Message and data rates may apply to SMS messages depending on your mobile carrier and plan. Message frequency may vary.

If you change your phone number, email address, or communication preferences, please notify Muse of Whimsy so that we can update our records.

By opting in to SMS or email marketing, you confirm that the contact information you provide is yours or that you are authorized to provide it.

Muse of Whimsy does not sell or rent your contact information to third parties for their own marketing purposes.

21.Third-Party Platforms

Certain services may rely on third-party platforms, including Squarespace, Cal.com, Zoom, payment processors, scheduling systems, email providers, or other technology providers.

Your use of those platforms may be subject to their own terms and privacy policies.

Muse of Whimsy is not responsible for outages, technical failures, security incidents, or other problems originating with third-party platforms, although we will make reasonable efforts to assist with service-related issues within our control.

22. Website and Online Content

Our website, newsletter, social-media content, and other online materials are provided for informational, spiritual, entertainment, and educational purposes.

We make reasonable efforts to provide accurate and thoughtful information but do not guarantee that all website or social-media content is complete, current, or error-free.

We may modify, discontinue, or update online content at any time.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Muse of Whimsy LLC and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of our services.

We are not responsible for decisions you make based on a tarot reading, astrology reading, spiritual service, website content, or other information we provide.

To the fullest extent permitted by law, our total liability arising from a particular service will not exceed the amount you actually paid Muse of Whimsy for that service.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

24. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Muse of Whimsy LLC and its owners, employees, contractors, and representatives from claims, liabilities, damages, losses, and expenses arising out of:

• Your violation of these Terms;

• Your misuse of our services or materials;

• Your violation of another person's rights; or

• Your unlawful or unauthorized use of our website, services, or content.

25. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or our services will be subject to the jurisdiction of the applicable state or federal courts located in New York, unless applicable law requires otherwise.

26. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will post the revised Terms with an updated “Last Updated” date.

Your continued use of our services after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

27. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

28. Entire Agreement

These Terms, together with any applicable service-specific policies, booking terms, written agreements, and our Privacy Policy, constitute the agreement between you and Muse of Whimsy concerning your use of our services, except where a separate written agreement expressly supersedes these Terms.

ETHICS & PRACTICE

Muse of Whimsy LLC believes that tarot and astrology should encourage curiosity, self-reflection, personal agency, and informed decision-making.

We strive to represent our abilities honestly and with integrity. We do not claim to have the ability to read minds, guarantee the future, or determine a person's fate.

The wheel of life is constantly turning. New information, choices, circumstances, and possibilities can arise every day. A tarot or astrology reading is one perspective—not a substitute for your own judgment.

We encourage clients to use readings as a tool for reflection rather than as an instruction manual for their lives.

We also do not encourage dependency on tarot readers, astrologers, psychics, or spiritual practitioners. If we believe that a client's use of our services has become compulsive, unhealthy, or otherwise inconsistent with our ethical practices, we may decline future bookings.

Muse of Whimsy LLC reserves the right to refuse service when reasonably necessary to maintain these standards, protect our clients and practitioners, or ensure that the services we provide remain consistent with our ethics and these Terms.
